Krokidas & Bluestein Litigators Pisegna and Meixel Save Family Millions in Estate Taxes

(BOSTON, MA) November 18, 2016 – Krokidas & Bluestein’s Vince Pisegna and Jill Brenner Meixel defeated an attempt by the Commonwealth of Massachusetts Department of Revenue to collect over $4.0 million in estate taxes from the children of a deceased who had amassed a significant portfolio of commercial real estate. DOR argued that decedent was a long-time resident of the Commonwealth of Massachusetts and had never officially changed his state of residency to Florida. DOR argued that at the time of death, the decedent owned significant property in Massachusetts, maintained an office in Massachusetts, and listed Massachusetts as his address in numerous corporate and real estate filings in the state. In response, K&B argued that, under the law, the decedent had evidenced a clear intent to change his domicile. Noteworthy is the fact that K&B commenced an action against DOR in Probate Court while internal appeals were pending at DOR, and of even more note, won the case on a motion for summary judgment before any discovery was taken, saving the client the time and significant expense (including running of interest) of waiting for a trial on the merits.
