Attorneys Pisegna and Lundberg Defeat Tenant Class Action

(BOSTON, MA) October 14, 2015 – Krokidas & Bluestein’s Attorneys Vince Pisegna and Janet Lundberg recently defeated a class action brought against its client, the owner of a rental housing development in Massachusetts, seeking in excess of $1.0 million in statutory and actual damages arising out of the alleged violation of the Massachusetts security deposit statute. Instead of responding to the plaintiff’s complaint by filing an answer, Pisegna and Lundberg filed a motion for judgment on the pleadings, a procedural device asserting that there were insufficient allegations as a matter of law to merit further litigation of the case. While the motion was pending, the plaintiff settled for a sum subject to a confidentiality agreement and the class action was dismissed.
